Administrative Law and Tenders

APM & Co.’s Administrative practice offers a wealth of experience representing clients in administrative appeals, negotiation with authorities and public tenders, including appeals to the Israeli Supreme Court sitting as the High Court of Justice. We counsel clients on all aspects of constitutional law and administrative law, including tenders, local authorities and municipal taxation. Our team also has a unique expertise in administrative proceedings in the environmental field.

Representing a wide range of clients which include some of the leading corporates in Israel, our Administrative Law practice has a proven track record and unmatched capabilities protecting our clients' interests while complying with the various legal instances.

Tenders:

Our administrative team advises public entities issuing tenders and represents clients at all stages of the bidding process, including appeals to disqualify winning tender bids or to cancel tenders, legality of winning tender bids, lawful conduct of tenders and implementing regulations governing the preferred status of Israeli products and National Priority Areas.

Our attorneys also play an active role in drafting legislation on public tenders, mainly regarding the preference of Israeli products.

Our Experience:

Some of the petitions we have filed include:

  • Appeals against successful bids for tenders issued by the Ministry of Defense (for the construction of the Israeli security barrier, the manufacturing and supply of combat helmets for Israeli soldiers, and the collection of used oils).
  • An appeal against the winning bid for the Israel Railways tender for construction of the high-speed railway to Jerusalem.
  • An appeal against the Israel Land Administration’s decision to reject an application for the tender-exempt allocation of land for the purpose of expanding a plant.

The experience we have accumulated dealing with various appeals filed to the Israeli High Court of Justice includes:

  • A petition to the Israeli Supreme Court of Justice submitted by Keshet Broadcasting Ltd. regarding alleged debts of Reshet Noga Ltd. owed to the Second Authority for Television and Radio. 
  • A petition to the Israeli Supreme Court of Justice against the Israeli Minister of Health and the Israeli Minister of Treasury regarding the remuneration of pharmacists.
  • A petition to the Israeli Supreme Court of Justice on behalf of Zeta, a leading olive oil manufacturer, against the Israeli Minister of Treasury, the Israeli Minister of Trade and Industry, the Israeli Minister of Agriculture, and the Plants Production and Marketing Board for the imposition of tariffs and quotas on the import of olive oil to Israel.
  • An administrative appeal on behalf of the Israeli Manufacturers Association (Food Industries Association) against new regulations limiting the loading and unloading of merchandise, set as part of the program to reorganize the public transport in the Dan region.
